Sunny 95 “Loyal Listener Club”
OFFICIAL RULES
NOTE: Due to the nature of our programs that are heard on-line over the internet, contests heard on the radio station’s internet audio stream are slightly delayed from the time the contests are heard on the broadcast station, and will be running behind the broadcast signal. Thus, all contests heard are delayed. This delay can last for as much as 30 seconds or more.
This means that when WSNY contests are played that require a specific caller to telephone the radio station (such as “Caller number 10 when you hear the sound effect”), listeners to the on-line audio stream may be at a disadvantage in participating over those listeners who hear the contests on-air.
1. METHODOLOGY: No purchase necessary to enter or win. This contest is subject to the limitations below. WSNY, Sunny 95 (94.7FM) will periodically conduct the “Loyal Listener Club” contest. The prize for the Sunny 95 “Loyal Listener Club” varies in value.
Listeners that have sent their email addresses to WSNY via the WSNY web site (http://www.Sunny 95.com), by the time of the contest Sunny 95 “Loyal Listener Club” email solicitation (the “cutoff time”) are eligible to participate in the contest. WSNY will transmit an email message to each email address in its database as of the cutoff time informing the email addressee of the identity of the cue to call, the time it will be played and the password sometime, if applicable. This email system is the only method WSNY will use to inform potential contestants of the identity of the Sunny 95 “Loyal Listener Club” contest, the hour in which it will be played and the password, if applicable.
At a determined date and time as indicated by the Sunny 95 “Loyal Listener Club” email, WSNY will air the cue to call in its entirety. Once the cue has begun, the WSNY announcer on duty will clear the phone lines, take the 9th caller, and ask for the password, if applicable. If the 9th caller gives the WSNY announcer on duty the correct WSNY password, if applicable, the caller will win the determined prize. If the 9th caller does not give the WSNY announcer on duty the correct password, or if the information provided has been falsified in any manner, the WSNY announcer on duty will continue to take callers until a caller has given the correct password to the announcer or an eligible winner has been determined.
The contest’s cue to call will not be announced or promoted on-air, and therefore there is a possibility that someone calling in for a request could be the 9th caller, and will not know that there is a contest going on. This scenario is the reason for the password or cue to call, which will ensure that the winner of the Sunny 95 “Loyal Listener Club” promotion received their contest information via the “designated” WSNY e-mail.
This contest is open to all residents of the WSNY total service area (as defined by Arbitron) at least 18 years of age, who hold a valid article of state identification. Employees, officers, directors, agents, representatives, and immediate families of employees of WSNY, Saga Communications, other Columbus radio stations and their parent companies, subsidiaries, affiliates, franchisees and advertising and promotional agencies are not eligible to participate or win the contest. After winning the prize, the winner is ineligible to win all other contests on WSNY for a period of 30 days for prizes valued at $599.00 or less, one year for prizes valued at $600 or greater.
2. ODDS OF WINNING: The number of calls received determines the odds of winning the prize, and can not be determined at this time. WSNY is not responsible for any errors, problems, or delays in the telephone systems that prevent callers from reaching WSNY. WSNY is not responsible for any errors, problems, server problems, or delays in the Internet or the email director software that prevent the delivery of the email. If any problems are discovered by WSNY, a different method of entry may be substituted and utilized. In the event the 9th caller gets disconnected during this contest before his or her name and phone number get recorded, then the prize will be awarded to the next caller whose name and phone number are recorded.
3. CONDITIONS TO AWARD OF PRIZES: Prizes are nontransferable. Winner may not substitute or transfer prize but WSNY reserves the right to substitute a prize of equal or greater value. WSNY, Saga Communications, their parent corporations, subsidiaries, affiliates, franchisees and advertising and promotional agencies assume no responsibility or liability for damages, losses, or injuries resulting from acceptance or use of prize. The prize winner will be required to sign and return an affidavit of eligibility and release of liability along with a release/hold harmless agreement and other documents before the prize will be awarded and not less then one week after WSNY declares the contestant a winner. Failure to comply with these conditions may result in forfeiture of the prize. The prize will be available for pick up in check form at the WSNY office. A WSNY employee will contact the prizewinner when check is available for pick-up.
By entering, the winner consents to the use of his or her name, likeness, and/or biographical information for advertising and promotional purposes without additional consideration. A valid social security number, address of place of employment, work phone number, and home phone number must be provided to WSNY by the winner. Other Columbus radio stations’ employees, interns, or volunteers of such stations are ineligible to win the prize.
By entering, participants agree to be bound by these official rules. Taxes on the prize are the sole responsibility of the winner. All federal, state, and local laws apply. Void where prohibited. Employees, officers, directors, agents, and representatives WSNY and its parent corporations, affiliates, subsidiaries and their employees, officers, directors, agents and representatives, and advertising and promotion agencies shall not be responsible for and shall not be liable for: (i) telephone system malfunctions, connections or transmission errors; (ii) any injuries, damages or losses of any kind caused by the prizes or use thereof or resulting from acceptance, possession or use of any prize or from participation in this contest, or (iii) internet system or email delays, malfunctions, connections or transmission errors. WSNY will make a good faith effort to transmit an email to each of the persons in its database, but WSNY does not guarantee that every person in its database will receive an email.
4. VALUE OF PRIZES: The value of the prize will vary from promotion-to-promotion.
5. DECISION OF THE JUDGES: The decision of the judges is final and binding. WSNY reserves the right to substitute prizes of equal value or end this contest at an earlier date. WSNY reserves the right to disqualify any winner if the contest rules have been violated in any way. Contest void where prohibited. Prize must be claimed within the prescribed time limits and methods set by WSNY. WSNY cannot be held responsible for unforeseen cancellations or delays of events caused by weather, client, or other extreme measures.
